FDA Authorization Guide
In the United States, authorization belongs to the exact tobacco product—not automatically to every item carrying the same brand.
Match the exact product
Confirm the manufacturer, product name, flavor, nicotine strength and package configuration against an FDA marketing order or the FDA searchable tobacco-product database.
Do not rely on brand recognition
An authorization for selected products does not authorize every strength, flavor, foreign-market edition or later variation under that brand.
Authorization is not “approval”
FDA marketing authorization does not mean a nicotine product is safe or “FDA approved.” Nicotine is addictive, and all tobacco products carry risk.
Recheck before sale
Product status and enforcement information can change. Retailers, distributors and importers should maintain SKU-level records and review current federal and destination requirements.
Use the current FDA list of authorized nicotine pouch products. A submitted or pending application is not a marketing authorization.
